Article 1 - Definitions

In these terms and conditions, the following definitions apply:

  • Additional agreement: an agreement in which the consumer acquires products, digital content and/or services related to a distance contract.
  • Withdrawal period: the period during which the consumer may exercise the right of withdrawal.
  • Consumer: any natural person acting outside the scope of their trade, business or profession.
  • Day: calendar day.
  • Digital content: data produced and supplied in digital form.
  • Durable medium: any tool enabling information to be stored for future use.
  • Right of withdrawal: the possibility for the consumer to cancel the distance contract within the withdrawal period.
  • Entrepreneur: Jaggs Alarm B.V.
  • Distance contract: an agreement concluded exclusively through remote communication methods.

Article 3 - Applicability

These Terms and Conditions apply to every offer made by Jaggs Alarm and to every distance contract concluded between the entrepreneur and the consumer.

Before the agreement is concluded, the text of these Terms and Conditions will be made available to the consumer.

Article 4 - The Offer

If an offer has a limited validity period or is subject to conditions, this will be explicitly stated.

The offer contains a complete and accurate description of the products, digital content and/or services offered.

Article 5 - The Agreement

The agreement is concluded at the moment the consumer accepts the offer and complies with the stated conditions.

If the consumer has accepted the offer electronically, Jaggs Alarm will immediately confirm receipt of the acceptance electronically.

Article 6 - Right of Withdrawal

The consumer may terminate an agreement regarding the purchase of a product within a withdrawal period of 14 days without giving any reason.

The withdrawal period starts on the day after the consumer, or a third party designated by the consumer, has received the product.

Article 7 - Obligations of the Consumer During the Withdrawal Period

During the withdrawal period, the consumer shall handle the product and packaging with care.

The consumer shall only unpack or use the product to the extent necessary to determine the nature, characteristics and functioning of the product.

Article 8 - Exercising the Right of Withdrawal and Associated Costs

If the consumer exercises the right of withdrawal, they must notify Jaggs Alarm within the withdrawal period.

The product must be returned as soon as possible, but no later than 14 days after notification of withdrawal.

The direct costs of returning the product are borne by the consumer, unless otherwise agreed.

Article 9 - Obligations of the Entrepreneur in Case of Withdrawal

Jaggs Alarm will reimburse all payments made by the consumer, including any delivery costs, within 14 days after receiving the withdrawal notice.

Refunds will be made using the same payment method used by the consumer for the original transaction, unless otherwise agreed.

Article 10 - Exclusion of the Right of Withdrawal

Jaggs Alarm may exclude certain products and services from the right of withdrawal if this is clearly stated in the offer.

This applies, among others, to:

  • Custom-made products
  • Sealed products that cannot be returned for hygiene reasons
  • Digital content delivered immediately
  • Business purchases

Article 11 - Pricing

During the validity period stated in the offer, prices will not be increased, except due to legal changes such as VAT adjustments.

All prices listed include VAT, unless stated otherwise.

Article 12 - Performance of the Agreement and Warranty

Jaggs Alarm guarantees that products and services comply with the agreement, the stated specifications, and reasonable standards of quality and usability.

Any additional warranties provided shall never limit the legal rights of the consumer.

Article 13 - Delivery and Execution

Jaggs Alarm will execute accepted orders as quickly as possible, and no later than within 30 days, unless another delivery period has been agreed upon.

If delivery is delayed, the consumer will be informed in a timely manner.

Article 14 - Duration Transactions

The consumer may terminate agreements concluded for an indefinite period at any time, subject to a notice period of no more than one month.

Article 15 - Payment

Unless otherwise agreed, amounts owed by the consumer must be paid within 14 days after concluding the agreement.

In the event of late payment, Jaggs Alarm is entitled to charge statutory interest and collection costs.

Article 16 - Complaints Procedure

Complaints regarding the execution of the agreement must be submitted to Jaggs Alarm within a reasonable time, fully and clearly described.

Submitted complaints will be answered within 14 days.

Article 17 - Disputes

All agreements between Jaggs Alarm and the consumer to which these Terms and Conditions apply are exclusively governed by Dutch law.

Disputes may be submitted to the competent court in the Netherlands.

Article 18 - Additional or Deviating Provisions

Additional or deviating provisions may not disadvantage the consumer and must be recorded in writing.
